HAFA- What is everyone talking about? Your Graceful Exit!
Last week I discussed the Trial Period for a Loan Modification. This week’s blog will focus on the brand new HAFA Program released by the US treasury department on April 5, 2010.There may be some changes made to the program in the coming months. With any new program, there will be tweaks until the program can create accountable results.
The HAFA program is short for the Home Affordable Foreclosure Alternative. This program offers brand new tools for struggling homeowners. When home buyers are not able to qualify for the HAMP or other modifications, the government created a new program to assist these borrowers in selling their homes. This program is of great benefit to all parties but most especially the real estate market which drives our overall economy. This program is set to expire December 31, 2012.
Qualifications for HAFA:
1. You must have been considered for other foreclosure prevention options. This includes: Loan Modication, deed in Lieu, forebearance etc.
2. Meet HAMP eligibility (see my April 24, 2010 blog)
3. Be either current or delinquent on your mortgage or in eminent default (its gonna happen)
One reason the lender wants you to have been considered or even denied for HAMP to qualify for HAFA is because the HAMP documentation is used to create your HAFA file. Also the lender does not have to delay his response for HAFA eligibility because the information is available to him immediately. What a concept! The HAFA client is a person who’s primary option is foreclosure.
These are the HAFA Guidelines and Incentives:
1. Incentives are at the forefront of this program:
a. $3000.00 assistance for a borrowers relocation costs
b. $1500.00 lender payment to cover administrative and processing costs
c. $2000.00 investor incentive who allow a total of up to $6000.00 in short sale proceeds to be distributed to the junior lien holder (second lien holder).
2. Lenders must comply with HAMP guidelines. Note: Not all lenders are HAFA eligible.
3. Borrowers can receive pre-approval short sale terms before listing the property.
4. Borrowers are RELEASED from FUTURE LIABILITY for the mortgage debt. No cash contribution, promissory note or deficiency judgement is allowed.
5. Most junior lien holders delay the processing of a short sale due to the lack of promised funds. Under HAFA the junior lien holder can expect 6% of the purchase price or $6000.00 almost twice what most are getting currently.

Home Modification Program: The Trial Period, What’s That all about?
Last week I talked about the loan modification program and the parameters for eligibility, this week I’m going to elaborate on the Trial period a loan modification borrower goes through before the modification becomes permanent.
The Home Affordable Modification Program requires every borrower to enter a Trial Period before they are eligible for a permanent modified loan.
Certain documentation must be submitted to the lender during this period. This includes copies of monthly agreed upon payments and lender required documents and forms. Your lender will supply you with the forms he/she requires.
The Trial Period is usually 90 days but could be more or less depending on the lender. Some advise my lender shares with my clients is don’t wait until your trial period expiration date to submit your documents, by then it’s too late. Your Trial Period Plan notice will have an expiration date on it. Double check your Request a Modification page and be sure to give your lender any missing documents as soon as you can.
If you’re not sure if your lender has all of your documents call the lender. Can I get a Loan Modification?
The best way to answer this question is to tell a story: Amy has a home loan that she can no longer afford. Her income has been reduced by 20%. She is an elementary school teacher. She lives in the same home she grew up in and doesn’t want to short sale it or let it go to foreclosure. What are her options?
HAMP, HAFA, FORECLOSURE, BANKRUPTCY, WALK AWAY……….. WHAT?
I will talk about HAMP in this blog.
HAMP: Home Affordable Modification Program: What is it? How can it help me?
Stats: Over 1.3 Million homeowners have submitted their applications. Problem: Only 168,000 loans have been permanantly modified.
Who is eligible? Only loans owned or guaranteed my Fannie Mae and Freddie Mac are currently eligible. If you don’t know who your service provider is on your loan call Freddie at 1800FREDDIE or Fannie at 18007FANNIE. You can also go to the Homeowners Help Hotline at 888-995-4673 to get some help or contact your real estate professional.
There are 5 questions asked by the service provider (bank, lender etc.) to determine if you’re eligible for HAMP.
1. Is your home your Primary Residence?
2. Is the amount you owe less than $729,750.00
3. Are you having trouble making your payments due to a financial hardship, loss of job, reduced income, etc.
4. Did you get your current mortgage before January 1, 2009?
5. Is the payment of your first mortgage (including Principal, Interest, Taxes and Insurance, HOA dues etc. more than 31% of your total income?
If you’ve answered yes to the questions above you can move onto the next step which is filling out forms for your lender. These forms are very specific to the lender but can be obtained from the MakingHomeAffordable. Gov website.
Once you fill out these forms you must gather your proof of income. After you’ve gathered all the documents, set up a meeting with your lender. Do not go or even attempt to call your lender before you’ve prepared your case.
Have a real estate ADVOCATE on your side. Be sure to consult with your tax professional and in some cases an attorney if your situation requires it.
Like anything, the loan modification request is a process. If it’s determined you’re not eligible for this program you do have options.
